The petitioner apprehends his arrest in connection with Fenhara P.S. Case No. 93 of 2018, registered under Sections 379, 411, 413, 414, 465, 468, 471 and 474 of the Indian Penal Code.

The accusation is that in course of checking of vehicle, one motorcycle was intercepted. In that course, while some persons succeeded to flee away but one person was apprehended, who disclosed his name as Rahul Singh @ Chhotu Singh and also disclosed that the said motorcycle was stolen by him with the help of Madhu Singh, Bholi Singh, Sunny Singh and petitioner.

Patna High Court CR. MISC. No.11169 of 2019(3) dt.16-05-2019 2/2 Learned counsel for the petitioner submits that petitioner was made accused in Shayampur Bhataha P.S. Case No. 18 of 2018 mere on suspicion due to that reason, he has been implicated in the present case. Further submission is that petitioner was put on T.I. Parade in Shayampur Bhataha P.S. Case No. 18 of 2018 on 04.04.2018 but he was not identified by the informant of the aforesaid case.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-XII, Motihari, East Champaran, in connection with Fenhara P.S. Case No. 93 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
