JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 15-03-2017 Heard learned counsel for the petitioner and the learned counsel representing the State.

The petitioner wants to renew the prayer of bail which was earlier rejected by order dated 22.04.2016 passed in Cri. Misc. No. 8699 of 2016, on the ground that the petitioner is in custody since 02.11.2015, in this case charges have been framed on 04.03.2016 but up till now only one witness has been examined and other witnesses are not turning up though the petitioner was given liberty to renew the prayer of bail after examination of the victim girl during trial, but the victim girl is not appearing in the Court.

The learned A.P.P. submits that direction be given to the learned trial Judge for examination of the victim girl. In the facts and circumstances stated above, finding

Patna High Court Cr.Misc. No.5244 of 2017 (3) dt.15-03-2017 2/2 no good ground for reconsideration of prayer of bail, again the prayer for bail of the petitioner stands rejected. However, the learned trial court is directed to expedite the trial and to conclude the same preferably within four months. The learned trial Judge will take positive steps to examine the victim girl also and after examination of victim girl during trial, the petitioner may be at liberty to renew his prayer for bail.
