JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 03-07-2020 Heard learned counsel for the petitioners and learned counsel for the State via video conferencing. By way of the present application, the petitioners have sought for pre-arrest bail in connection with Nautan P.S. Case No.237 of 2016 registered for the offences punishable under Sections 8, 9 and 10 of the Protection of Children from Sexual Offences Act, 2012.

Considering that initially a complaint was filed, which was referred to the police for institution of the first information report in exercise of powers conferred under Section 156(3) of the Code of Criminal Procedure and on completion of investigation, the police submitted final form

Patna High Court CR. MISC. No.12467 of 2020(3) dt.03-07-2020 2/2 holding the accusation to be false and malicious and differing with the police report, the court below took cognizance of the offence, the petitioners are directed to be released on bail in the event of their arrest or surrender in the court below on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-1st-cum-Special Judge, POCSO, West Champaran at Bettiah in connection with Nautan P.S. Case No.237 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
