JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-01-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case is that the F.I.R named accused persons along with 3-4 unknown came to the flour mill of the informant when petitioner assaulted with the butt of the pistol on the head of the informant and resorted to fire but it did not hit the informant. It is alleged that co-accused Vinod Singh took out Rs. 20,000/- from the cash box of the informant when threatening was also given by the accused persons. It is submitted by learned counsel for the petitioner that in the background of land dispute the accusation has been levelled. The injury has been found to be simple in nature.

Patna High Court Cr.Misc. No.1544 of 2016 (2) dt.12-01-2016 2/2 A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Mairwa P.S. Case No. 104 of 2015, pending in the Court of learned Chief Judicial Magistrate, Siwan.

With the observations above, the application stands disposed off.
