JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State.

Petitioner is named in the first information report but admittedly, the informant is not an eye witness of the alleged occurrence and she expressed her suspicion against the petitioner on the ground of land dispute.

Although learned court below has referred some paragraphs of the case diary to show the complicity of the petitioner in the commission of the alleged occurrence but submission on behalf of the petitioner is that almost all the prosecution witnesses have made similar statement as stated by the informant in this case.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.57212 of 2015 (2) dt.18-12-2015 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Araria in connection with Raniganj P.S.Case No. 209 of 2015.
