JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-03-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Rajgir P.S. Case No.395 of 2019 for offences under Sections 420, 406, 467, 468, 471, 120B, 506 and 504/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent.

The allegation against the petitioner is that he has shown land measuring 10 decimals for sale and the informant gave Rs. 18,00,000/- in cash to the petitioner and the said land was got registered in the name of Devendra Kumar by the petitioner. It is further alleged that the petitioner assured the informant to return the aforesaid amount.

Case No. 394 of 2019 registered by the petitioner is earlier in point of time whereas the present case i.e. Rajgir P.S. Case No. 395 of 2019 has been registered against the petitioner and others. He further submits that other co-accused persons, namely, Indradeo Prasad and Madhu Sinha have been granted anticipatory bail by the court below vide order dated 04.05.2019 passed in A.B.P. N. 2816 of 2019.

Considering the fact that the petitioner has no criminal antecedent, there is case and counter case between the parties and the case registered at the instance of the petitioner against the informant side is earlier in point of time, this Court is inclined to grant bail to him. Let petitioner, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Rajgir P.S. Case No. 395 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. BT/- (Anil Kumar Upadhyay, J) U T
