The petitioner seeks bail in connection with Bihar P.S. Case No. 476 of 2016 registered for the offences punishable under Sections 467, 468, 420, 414, 120B of the Indian Penal Code. Allegedly, the petitioner was apprehended on secret information whereas one person succeeded in fleeing away and from possession of the petitioner 32 ATM cards of different banks, one motorcycle and other incriminating articles were recovered as per seizure list.
Submission is of false implication and that nothing has been recovered from conscious possession of the petitioner. The Police has obtained signature on the blank paper and has converted it into the alleged seizure list and as such the petitioner who is suffering
Patna High Court Cr.Misc. No.1834 of 2017 (2) dt.19-01-2017 in custody since 31.10.2016 deserves sympathetic consideration. Learned APP opposes the prayer of bail by submitting that the petitioner was caught with 32 ATM Cards of different banks of different persons, he is involved in withdrawing money through ATM and during investigation witnesses have supported the allegation.
In the facts and circumstances stated above, considering the alleged recovery, at present, this Court is not inclined to enlarge the petitioner on bail, accordingly, his such prayer stands rejected. (Jitendra Mohan Sharma, J) avin/- U T
