Petitioner seeks bail in a case registered for the offences punishable under Sections 379/34 of the Indian Penal Code.

The bail was granted by the learned court below to the petitioner vide order dated 12.12.2018 passed in B.P. No. 630 of 2018, however, the condition of bailor was imposed as one bailor must be government servant and another a respectable person of the village.

Submission is that no government servant is known to the petitioner and no villager is there who is not a respectable person. The condition requires modification.

Considering the facts, it is ordered that the bailors shall be resident of within the territorial jurisdiction of the

Patna High Court CR. MISC. No.10879 of 2019(3) dt.03-05-2019 2/2 learned court below having immovable property including family members of the petitioner.

Accordingly, this application is disposed of in connection with Itarhi P.S. Case No. 160 of 2018 pending in the court of learned Chief Judicial Magistrate, Buxar. (Birendra Kumar, J) Kundan/- U T
