Petitioners seek bail in a case registered for the offences punishable under Sections 147, 148, 149, 447, 341, 323, 302, 379, 506, 504 of the Indian Penal Code, Section 27 of the Arms Act and Section 3/4 of the Explosive Substance Act. The FIR named accused persons including the petitioners, allegedly, fired on the prosecution side. One person was killed by bomb blast.

Submission of the petitioners is that the petitioners have got no criminal antecedent. There is no witness who stated before the police that the petitioners had thrown the bomb. All were identified firing against the informant and others.

No.4050 of 2017 (3) dt.21-03-2017 2/2 Considering the aforesaid facts, let the petitioners, above named, be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka/successor Court in connection with Banka Police Station Case No. 479 of 2016 corresponding to G.R. No. 1685 of 2016, subject to the condition that the petitioners shall fully co-operate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
