The petitioner has preferred this application for grant of regular bail in a case registered under sections 413 and 414 of the Indian Penal Code.

As per the prosecution case, a motorcycle was recovered from the possession of the petitioner and it is stated that on demand no documents with respect to the same was produced by him.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. It is further submitted by learned counsel for the petitioner that he was not aware that the motorcycle in question was a stolen property. The same was purchased by him. He is in custody

Patna High Court CR. MISC. No.20650 of 2021(2) dt.23-09-2021 2/2 since 11.11.2020 and has no criminal antecedent. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner not having any criminal antecedent and having remained in custody for over 10 months, the Court directs the petitioner to be enlarged on bail in connection with Yogapatty P.S. Case no.454 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran.
