The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 323, 384, 420, 406, 120B, 307, 354 B, 468, 471 & 504/34 of the Indian Penal Code.
It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place. Petitioners have been falsely implicated in this case. The allegation levelled against the petitioners is not specific rather general and omnibus in nature. As a matter of fact, no occurrence in the manner as alleged has ever taken place and the
Patna High Court CR. MISC. No.9343 of 2020(5) dt.01-03-2021 2/2 entire prosecution version is false and concocted. Petitioners have no concern of the alleged occurrence. It is further submitted that alleged brick kiln belongs to co-accused, Md. Sabir Ansari, who is separate in mess and business from the petitioners. It is lastly submitted that the matter is civil in nature. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Madhubani in connection with Rajnagar P.S. Case No.317 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
