JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-04-2023 The present writ petition has been filed seeking the following reliefs:- "1(I). To issuance of an appropriate writ in the nature of mandamus to quash and cancel the notice bearing No. 26/XI dated 11.7.2016 and 87/XI dated 12.9.2016 (Annexure-2) issued under the authority of Circle Officer whereby and whereunder the learned Circle Officer has called this petitioner to clarify the matter with respect to vacating the khata no. 10, khesra no. 423 situated under Circle Rahika (Madhubani) where the petitioner is running his shop as tenant of Sita Ram Murli Manohar Trust and paying rent thereof.
Patna High Court CWJC No.18388 of 2016(2) dt.06-04-2023 2/2 (II). To hold and declare that the land under reference of the said notice is the land of said trust, thus, notice should to the Trust and not to any other because only trust is the owner / title holder of the land in question.
(III). To direct the respondent to not disturb and harass this petitioner by sending notice which is under challenge of this application"
After some arguments, the learned counsel for the petitioner seeks to withdraw the present writ petition with liberty to approach the Respondent authorities for redressal of his aforesaid grievances.
