JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Forbesganj P.S. Case No. 430 of 2016, registered under Sections 147, 341, 342, 354(B), 355, 379, 500, 504, 509 and 506 of the Indian Penal Code.

The accusation is that the husband of the informant died before seven years and due to that reason she was unable to maintain her children. Thereafter, on 16.08.2016 informant performed her remarriage with her villager Md. Yusuf, but the other villagers were not happy with her remarriage with Md. Yusuf. Thereafter, a Panchayati was arranged in which 11 persons, including the petitioner and 100 to 150 unknown participated in the panchayati. Thereafter, informant and

Learned counsel for the petitioner submits that while the petitioner is named in the F.I.R. along with ten others in the F.I.R., but no specific overt act has been attributed against the petitioner and the petitioner has no criminal antecedent. The petitioner is in custody since 21.11.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 430 of 2016.
