The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149, 323, 364, 365 & 302 of the Indian Penal Code.

Today learned counsel for the petitioner has filed a supplementary affidavit which is kept on record. The petitioner in association of other co-accused is said to have murdered the informant's wife by slitting her neck over a trivial dispute.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He is quite innocent and has been falsely implicated in this case due to dirty village politics. No incriminating article has been recovered

Patna High Court CR. MISC. No.19943 of 2021(3) dt.26-10-2021 2/2 from his conscious physical possession. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The petitioner and informant are co-relative. Coaccused, namely, Jagdish Manjhi and Ram Bilash Manjhi have been enlarged on bail by different co-ordinate bench of this court vide order dated 30.09.2019 and 08.03.2021 passed in Cr. Misc. No.49089 of 2019 and Cr. Misc. No.1856 of 2021 respectively. The petitioner has no criminal antecedent and has been languishing in custody since 06.02.2020. Learned APP for the State opposed the bail petition.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Sirdala P.S.
