JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2019 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 13.12.2018 passed in Cr.Misc.No. 65359 of 2018 and the allegation as per FIR is that Samdhi of the informant was surrounded by accused persons and they fired at the deceased, causing his death. Petitioner is accused in 10 other cases.

Submission of learned counsel for the petitioner is that petitioner is not named in the FIR and later on his name transpired on the information of Spy and he is granted bail in all other cases except one case and now charge has been framed and petitioner is in custody since 7.4.2018.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant bail to

Patna High Court CR. MISC. No.10951 of 2019(2) dt.27-02-2019 2/2 the petitioner at this stage. However, learned trial court is directed to expedite the trial and if trial is not concluded within a period of six months, petitioner is at liberty to renew his prayer for bail.

With the above observation, this application is dismissed.
