The petitioner seeks bail in a case registered for the offence punishable under Sections 302, 379, 34 of the Indian Penal Code and Section 27 of the Arms Act.

In pursuance to the order dated 10.05.2023, status report of trial in connection with Mahishi (Jalai) P.S. Case No. 132 of 2011 has been received and kept at Flag-R, in which it is reported that the prosecution has examined altogether seven witnesses in this case till today and as per charge-sheet, nine witnesses are yet to be examined including the informant. It is further reported that approximately six months time is likely to be taken for conclusion of trial.

Considering the present stage of the trial, I am not inclined to enlarge the petitioner on bail. Accordingly, his payer for bail is rejected in connection with Mahishi (Jalai) P.S. Case

Patna High Court CR. MISC. No.12779 of 2023(5) dt.21-06-2023 2/2 No. 132 of 2011 pending before the court of the learned Additional Sessions Judge-V, Saharsa.

Accordingly, the application is dismissed. However, Trial Court is directed to conclude the trial as expeditiously as possible within a period of six months.
