JUSTICE MUNGESHWAR SAHOO ORAL ORDER 17-12-2015 Heard the learned counsel for the petitioner and learned A.P.P. for the State.

The petitioners (1) Bira Sahani @ Bhutan Sahani (2) Lalpari Devi, are in custody since 11.07.2015 in Piprakothi P.S. Case No.73 of 2015 under Section 341, 342, 504, 506 of IPC and Section 3(2) (v) SC/ST Act and 4, 6, 8 of POSCO Act. The learned counsel for the petitioner submitted that the allegation of rape is against the co-accused Kaushal Singh. So far the allegation against the petitioner No.1 is that he started hurling kudal and petitioner No.2 was abusing.

Considering the nature of allegation against these petitioners

Patna High Court Cr.Misc. No.55662 of 2015 (2) dt.17-12-2015 2/2 and period of detention, I direct that both the above named petitioners be released on bail on furnishing bail bond of Rs.5,000/- (five thousand only) each with two sureties of the like amount each to the satisfaction of learned A.D.J. 1st, East Champaran at Motihari in connection with Piprakothi P.S. Case No.73 of 2015.
