The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 409 of the Indian Penal Code.

The petitioner, who is Block Welfare Officer, was found missing without information as a result whereof inconvenience was caused in distribution of grains under the PDS scheme.

Submission is that this may be a case of disciplinary proceeding and no criminal liability is made out. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the

No.3777 of 2017 (2) dt.09-03-2017 2/2 Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria/Successor Court in connection with Beldaur Police Station Case No.184 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
