The petitioners apprehend their arrest in a case registered for the offences punishable under Section 498A and other allied sections of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act.
Allegation is of commission of torture and harassment due to non-fulfillment of demand of dowry.
It is submitted that thrust of accusation is against husband of informant. Petitioner no. 1 is mother-in-law and
Patna High Court CR. MISC. No.10281 of 2023(2) dt.12-05-2023 2/2 petitioner no. 2 is father-in-law of the informant. There is general and omnibus allegation. Petitioners are separate in mess and property and they have got no concern with the family affairs of their son and informant. Petitioners claim clean antecedents.
Counsel for informant however vehemently opposed the prayer for bail.
Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Town P.S.
