Petitioner, who is in custody, seeks bail in connection with Danapur P.S. Case No. 560 of 2018 registered for the offence punishable under Section 302/34 of the Indian Penal Code and 27 of Arms Act.

Informant who is the mother of deceased has stated in her written complaint that on 19.08.2018 at about 3.00 AM when her daughter had woke up to attend call of nature she informed her that petitioner has committed murder of son of informant Md. Farukh Ansari through window and thereafter other inmates of the house woke up and her son Farukh Ansari was carried to hospital where doctor declared him brought dead.

No.11639 of 2019(4) dt.04-04-2019 2/3 It has been submitted on behalf of the petitioner that she is innocent and has been falsely implicated in this case on concocted story. During investigation it has come that the brother of deceased who was sleeping with him had gun powder all over his hand and in order to save her son she has implicated petitioner because of previous dispute and enmity. The allegations as made appears to be improbable. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Danapur, Patna, in connection with Danapur P.S. Case No. 560 of 2018 subject to the conditions that:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and her absence on two consecutive dates without proper and sufficient reason the trial court will be at liberty to cancel her bail bond.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
