JUSTICE MADHURESH PRASAD ORAL ORDER 19-01-2018 The instant MJC has been filed for restoration of Miscellaneous appeal which has been dismissed for non filing of the requisites for issuance of notice vide order dated 12.2.2015.

Counsel for the appellant submits that due to a mistake in calculation of peremptory period, requisites for issuance of notice has been filed one day late by the office of the petitioner's counsel.

In view of the aforesaid stand, the time granted by order dated 12.2.2015 is extended by one day and the filing of requisites is taken as filed in time. Let the office take steps for issuance of notice.

MJC is thus allowed and the Miscellaneous appeal is restored to its original records.
