JUSTICE BIRENDRA KUMAR ORAL ORDER 15-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 393/398/307 of the Indian Penal Code and Section 27 of the Arms Act.

The F.I.R. is against unknown. The petitioner was arrested merely on suspicion and thereafter his confessional statement was recorded by the police. Later on the petitioner was remanded in other criminal cases also on the basis of the confessional statement.

Considering the fact that there is no substantial material against the petitioner for the purpose of bail, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like

Patna High Court Cr.Misc. No.2768 of 2017 (3) dt.15-03-2017 2/2 amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur/Successor Court, in connection with Ahiyapur P.S. Case No.902 of 2015, with condition that one of the bailors shall be local having immovable property and another close family member.
