The petitioner seeks bail in a case registered under Sections 302, 379/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that the co-accused Babulal Chauhan fired upon Suletan Chauhan, due to which he sustained grievous injury and in course of treatment he died. The accused persons including the petitioner assaulted and informant and his family members, due to which they sustained injuries. It has been submitted on behalf of the petitioner that the petitioner is in custody since 01.11.2019. Charge sheet has been submitted in this case. There is no allegation of tampering

Patna High Court CR. MISC. No.9085 of 2020(2) dt.04-03-2020 2/2 of witnesses alleged against the petitioner. The petitioner is a member of unlawful assembly. No injury is attributed against the petitioner. Co-accused Babulal Chauhan fired upon the deceased which led to death of the deceased.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Smt. Sangita Kumari, J.M. 1st class, Nawada in connection with Nardiganj P.S. case No.147 of 2017.
