1. Heard the parties.

2. Petitioner seeks regular bail in connection with Khizersarai P.S. Case No. 190 of 2024 dated 15.06.2024 registered under Section 366-A, 34 of the I.P.C.

3. As per the prosecution case on 14.06.2024 while the informant was sleeping with his family members and his daughter was sleeping in another room, at about 3:00 A.M. when the informant woke up, he found that his daughter was missing. It has further been alleged that the son of the petitioner kidnapped the minor daughter of the informant for the purpose of marriage.

4. Learned counsel for the petitioner submits that there was

Patna High Court CR. MISC. No.10128 of 2025(2) dt.13-02-2025 2/3 love relationship between the son of the petitioner and the victim girl, whose age as per medical report is between 18-19 years. He further submits that the victim girl was examined by the learned Magistrate and her statement was recorded under Section 164 Cr.P.C. in which she has disclosed her age as 19 years and she has also stated that she willfully eloped with the son of the petitioner as she was in love with him. The petitioner has been made accused merely because she happens to be the mother of the co-accused / Sachin Kumar, who has been granted anticipatory bail by this court in Cr. Misc. No. 81631 of 2024. The petitioner is in custody since 04.12.2024.

5. Learned counsel for the informant opposes the prayer for bail and submits that as per school certificate the victim girl was minor and allegation against the petitioner is that she made marriage ceremony viral on the social media.

Regard being had to the submissions made by the parties, taking into consideration the fact that the petitioner is the mother of the co-accused, with whom the victim girl was having love relationship and the co-accused / Sachin Kumar i.e. the son of the petitioner has been granted anticipatory bail by this court, as such, I am inclined to grant regular bail to the petitioner.

7. Let the petitioner, above named, be released on regular

Patna High Court CR. MISC. No.10128 of 2025(2) dt.13-02-2025 3/3 bail on furnishing bail bond of Rs. 10000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Khizersarai P.S. Case No. 190 of 2024.
