Petitioner seeks bail in a case registered for the offences punishable under Sections 364/34 of the Indian Penal Code.

The daughter of this petitioner asked the son of the informant to go to her house. Thereafter, the petitioner and her husband and other family members allegedly have hidden to the son of the informant and son of the informant is missing. Submission is that chargesheet was submitted without collection of evidence and recovery of the victim boy and further investigation has been kept pending. Considering the aforesaid material, husband of the petitioner has already been allowed bail.

Considering the fact that there is no direct evidence against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Darauli Police Station Case No.188 of 2015, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

Let the Superintendent of Police, Siwan submit a report as to what step has been taken for recovery of the victim boy in connection with Darauli P.S.Case No.188 of 2015. Let a copy of this order be sent to the Superintendent of Police, Siwan.

The report must come within four weeks.
