The petitioner has preferred this application for grant of regular bail in a case registered under sections 414 and 411 of the Indian Penal Code and sections 20(B)(II)(C) and 22(C) of the NDPS Act.

As per the prosecution case, total of 5 kgs. of ganja was recovered from two motorcycles and the petitioner was taken into custody.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has been falsely implicated in the case. The petitioner is in custody since 14.8.2020 and chargesheet has

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 1 year and chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Special Case no. 116 of 2020 (arising out of Fatuha P.S. Case no. 571/2020) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District Judge, XVII, Patna.
