ANJANA MISHRA ORAL ORDER 18-03-2016 Learned counsel for the petitioners seeks permission of the Court to withdraw the application against petitioner No. 3 (Doman Mandal) as he has already been taken into custody. It is thus, dismissed as withdrawn so far as petitioner No. 3 is concerned.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State as well as learned counsel appearing on behalf of the informant. The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Diary in this case was called for earlier which has since been received.

After hearing learned counsel for the parties, it appears that the dispute arose on account of petty quarrel between the children who were playing together.

Patna High Court Cr.Misc. No.2808 of 2016 (3) dt.18-03-2016 P2/2 It has been submitted on behalf of the petitioner that the deceased fell down from the bridge resulting in injury to back causing his death. The post-mortem report indicates that there was injury on the back. Kidney and spleen were also damaged. There was no other injury recorded in the said report. Considering the nature of injury as available in the case diary and that there being no further cogent material therein and also because of the fact that the petitioners are ladies, let the petitioners, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Sangrampur (Tatiyabamber) P.S. Case No. 125/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
