The petitioner is apprehending his arrest in connection with Siwan Town P.S.Case No.615 of 2018 , registered for offences punishable under Sections 420/120B of the Indian Penal Code and Section 52 of the Bihar Prohibition and Excise Act..
Allegation as per FIR is that 386 cartoons of English liquor have been seized by them but they have shown seizure of only 280 cartoons of liquor .
Submission of the learned counsel for the petitioner is that he is only a constable and not incharge of the Malkhana and another co-accused who is Incharge of the Malkhana has been granted privilege of anticipatory bail by this Court, vide
Patna High Court CR. MISC. No.10999 of 2019(4) dt.07-05-2019 2/2 order dated 12.3.2019 passed in Cr. Misc. No.14572 of 2019. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Siwan in connection with Siwan Sadar P.S.Case no.615 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid direction, this application is allowed.
