JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-02-2016 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. representing the State.

The petitioner seeks bail in connection with Surajgarha P.S. Case No. 121 of 2015 registered for the offences punishable under Section 302/201 of the Indian Penal Code. Minu Devi, cousin sister of the informant was married to petitioner six years ago and she was killed by the petitioner and other in-laws and made the dead body traceless. It is also alleged that four years old daughter and 6-7 months old son of the deceased are also traceless.

Submission is of false implication and that marriage took place 12-13 years back, no dowry was ever demanded and family members of the deceased have not come to lodge this case

Patna High Court Cr.Misc. No.55926 of 2015 (3) dt.10-02-2016 2/2 against the petitioner, there is no specific allegation and the police after completing investigation submitted chargesheet under Sections 306, 201/34 IPC as victim herself consumed poison. Other co-accused has already been granted bail and the petitioner is suffering in custody since 29.06.2015, deserves sympathetic consideration.

The learned A.P.P. duly assisted by the learned counsel for the informant opposes the prayer of bail by submitting that after perusal of case diary, cognizance has been taken under Sections 302, 201/34 of the IPC and all the witnesses have supported that Minu Devi was killed by the petitioner and others and made the dead body traceless and further four years aged daughter and 6-7 months old son of the deceased were also made traceless.

In the facts and circumstances stated above, considering the allegation attributed against the petitioner, serious in nature, this Court is not inclined to enlarge the petitioner on bail and accordingly, his such prayer stands rejected. However, let the trial be expedited.
