JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-02-2019 At the very outset, learned counsel for the petitioners submits that petitioner No.1, Raja Kumar, has been arrested during the pendency of this application and as such he seeks permission to withdraw this application with respect to petitioner No.1.
In the said circumstances, this application with respect to petitioner No.1 is dismissed as withdrawn. Petitioner No. 2 is married Nanad and petitioner No.3 is mother-in-law and allegation against them is of subjecting the victim lady to cruelty with respect to demand of Rs.2 lakh. Submission of learned counsel for the petitioners is that the whole family members have been made accused in this case and no specific allegation has been attributed against them.

Having heard both sides and in the facts and circumstances, let petitioner Nos. 2 and 3, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Rajapakar P.S. Case No. 157 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
