The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 147, 149, 341, 323, 504, 506, 307 and 302 of the Indian Penal Code. Allegedly, it is a case of assault upon the deceased, namely, Baliram Das and one another by the accused persons by means of iron rod and lathi.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner is not named in the FIR but during the course of investigation, the brother of the deceased named this petitioner. There is no specific allegation of assault against this petitioner upon the deceased Baliram Das and
Patna High Court CR. MISC. No.9941 of 2022(4) dt.14-11-2022 2/2 specific allegation of assault is against co-accused Girijesh Das and Sudhir Das. Petitioner has clean antecedent. Learned APP appearing for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-III, Gaya in connection with Konch P.S. Case No. 257 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
