The Petitioner, Zeyaul Haque, is in custody in Majhaulia P.S. Case No. 67 of 2015 under Sections 366A/34 of the Indian Penal Code and Section 8 of the POSCO Act.

Learned counsel for the petitioner submitted that, in fact, the girl i.e. daughter of the informant, namely, Phoolsana Khan, and this petitioner had married. The statement of the daughter of informant has been recorded under Section 164 Cr.P.C., wherein the court also found her age is about 20 years. Considering the statement of Phoolsana Khan, she has been released by the Court and now, she is living with the petitioner.

Perused the statement of Phoolsana Khan, recorded under Section 164 Cr.P.C. She has clearly stated that she had

Considering the above facts and circumstances, I direct the petitioner, named above, to be released on bail on furnishing bail bond of Rs.10,000-(Ten thousand rupees) to the satisfaction of learned 1st Additional Session Judge, West Champaran in connection with Majhaulia P.S.
