2. Counsel for the petitioner submits that the petitioner was working as home-guard in Madhubani and died in harness. He further submits that petitioner has demanded the payment of Ex-gratia amount as per the rules to the petitioner whose husband was working in District Madhubani being Home Guard No. 9423 who died in harness when posted at the house of Circle Officer, Benipatti, Madhubani.

3. Counsel for the petitioner submits that petitioner has filed representation to the District Commandant, Home Guard, District Madhubani, but no reply has been received yet.

4. Counsel for State submits that counter has not been filed, but petitioner may be directed to file a fresh representation before the District Commandant, Home Guard, District Madhubani and the District Commandant, Home Guard, District Madhubani may be directed to pass reasoned and speaking order considering the representation of the petitioner within 90 days from the date of production of the order.

5. Ordered accordingly.

6. In this view of the matter, writ petition is disposed of.
