The petitioner is accused in connection with Kishanganj P.S. Case No. 131 of 2015, registered under Section 302, 201/34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that the petitioner happens to be the wife of the deceased Mahesh Chouhan, brother of the informant. It is further submitted that, in fact, petitioner was at her Myaka and the dead body of the deceased was found in his house, but due to ulterior motive to grab the property, she has falsely been implicated in this case stating that petitioner has illicit relationship with her brother-inlaw. It is further submitted that co-accused, namely, Sushil
Patna High Court Cr.Misc. No.55221 of 2015 (3) dt.01-02-2016 Prasad Saha @ Bhoti and Santosh Saha @ Santosh Kumar, have already been granted privilege of bail by a Bench of this Court on 24.09.2015 passed in Criminal Misc. No. 28015 of 2015 and Criminal Miscellaneous No. 37957 of 2015, respectively. The petitioner has no criminal antecedent and she is in custody since 22.04.2015.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II/Trial Court, Kishanganj in connection with Kishanganj P.S. Case No. 131 of 2015.
