JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-01-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420/34 of the Indian Penal Code.

The prosecution case is that the mother of the petitioner namely Fula Rani entered into an agreement with the informant for transfer of a land appertaining to Khata No. 232, Survey Plot No. 77, Area 2 Khata 10 Dhur for consideration amount of Rs. 1 crore 5 lacs, out of which Rs. 70 lacs were given in cash. The petitioner identified the signature of his mother on the agreement but subsequently a cheque of Rs. 10 lacs were issued which got bounced and land was not transferred.

It is submitted by learned counsel for the petitioner that petitioner is not a party to the agreement and he simply identified the signature of his mother. The mother of the

Patna High Court Cr.Misc. No.3421 of 2016 (2) dt.21-01-2016 2/2 petitioner is already in custody. Moreover a legal notice was already served to the mother of the petitioner. Considering the fact that thrust of accusation is against the mother of the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur, Patna in connection with Danapur P.S. Case No. 82 of 2015, arising out of Complaint Case No. 1310(C) of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
