JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 14-12-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Sadar P. S. Case No. 416 of 2015 registered under Sections 272 and 273 of the Indian Penal Code and Section 47(a) of Excise Act. It has been contended that nothing has been recovered from the possession of the petitioner. The place from where the alleged recovery of countrymade liquor has been made does not belong to the petitioner.

On the other hand, learned counsel for the State has opposed the prayer for bail of the petitioner. He has submitted that 96 litres of illicit liquor was recovered from a place belonging to

Be that as it may, regard being had to the nature of offence, the above named petitioner, who is a man of clean antecedent and is in custody since 17.10.2015, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Purnea in Sadar P. S. Case No. 416 of 2015.
