2. The petitioners seek bail in connection with Sonepur P.S. Case No. 594 of 2023 registered for the offence punishable under Sections 341, 323, 324, 307, 354, 504 and 506/34 of the Indian Penal Code and subsequently Section 302 of the I.P.C. was added.

3. As per the prosecution case, the petitioners and other co-accused persons are said to have assaulted the victim and causing death of the victim during treatment.

4. Learned senior counsel appearing for the petitioners has relied upon the post-mortem report and has submitted that

The petitioners are in custody since 25.07.2023. Learned counsel further submits that a coordinate Bench of this Court vide order dated 22.02.2024 in Cr. Misc. No. 11294 of 2024 has granted bail to a similarly situated co-accused namely, Pramod Singh.

5. Learned counsel for the informant has vehemently opposed the prayer for bail and submitted that this is a case of murder and the petitioners should not be released on bail.

6. Leaned APP for the State has also opposed the prayer for bail.

7. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioners, above named, be released on bail, after framing of charge if charge not already framed, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saran at Chapra in connection with Sonepur P.S. Case No. 594 of 2023.
