The petitioners seek bail in connection with Barahara P.S. Case No. 85 of 2015 registered under Section 392 of the Indian Penal Code and 27 of the Arms Act. It is contended that the petitioners are neither named in the FIR nor any incriminating article has been recovered from their possession. Though they are in custody since 05.08.2015, without holding T.I. Parade, the police have submitted charge-sheet in the case. It is further contended that the petitioners have got no criminal antecedent. They have got

Patna High Court Cr.Misc. No.56094 of 2015 (2) dt.15-12-2015 2 / 2 roots in the society and are not likely to abscond or tamper with the evidence.

Regard being had to the facts and circumstances of the case, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Barahara P.S. Case No. 85 of 2015.
