The petitioner apprehends his arrest in a case registered for the offence under Sections 379, 420, 468 and 471 of the Indian Penal Code.

It is alleged by informant that a blank signed cheque was lying at his house, which was stolen by this petitioner and after filling his name and amount of Rs. Five lacs, got transferred the amount in his account.

It is submitted on behalf of petitioner that the informant himself has issued the above cheque of Rs. 5 lacs and when the said cheque was cleared, the informant made complaint to the concerned bank and lodged this false case. Petitioner is none else but own maternal brother of informant. It is further submitted that the police after investigation has already submitted final form. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.11628 of 2023(2) dt.28-04-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bhojpur, Ara in connection with Dhangai P.S. Case No. 99 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
