Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with K.Hat (Sahayak) P.S. Case No.148 of 2016 registered under Sections 457, 380 and 411 of the Indian penal Code.

Regarding the theft of gold and silver ornaments, 18 pieces of silver coins and cash Rs.18000/- from the house of the informant, the present case was lodged against unknown on the basis of the written report of the informant.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of

Patna High Court Cr.Misc. No.5724 of 2017 (3) dt.12-04-2017 2/2 investigation, the petitioner was apprehended by the police on mere suspicion and, thereafter, the police got recorded the confessional statement of the petitioner showing his involvement in committing the theft at the house of the informant and three silver coins are said to be recovered from the pocket of the paint of the petitioner, kept in his house. Further submission is that while the petitioner is accused in six other cases but in all that cases, the petitioner is on bail and in the present case, the petitioner is in custody since 22.04.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.

10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, in connection with K. Hat (Sahayak) P.S. Case No.148 of 2016. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
