2. The petitioners seek bail in connection with Gaunaha PS Case No. 64 of 2013 instituted for the offences punishable under Sections 467, 468, 471, 420, 406/34 of the Indian Penal Code.

3. As per the prosecution case, the allegation against the petitioners are that they are involved in forged voter identification card and tried to get benefits of social welfare pension yojana.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence and have falsely been implicated in this case. He next submits that

Patna High Court CR. MISC. No.12182 of 2024(2) dt.05-03-2024 2/2 the petitioners are poor persons and they have no concerned with the social welfare pension yojana. Petitioners have got no criminal antecedent as stated in para 3 of the petition. Petitioners are in custody since 10.11.2023.

5. Learned APP opposes the prayer for bail.

From perusal of the FIR, case diary and the impugned order of the learned District and Sessions Judge, West Champaran, Bettiah dated 12.01.2024, it appears that petitioner no. 1 is a lady aged about 62 years and petitioner no.2 is aged about 66 years having no knowledge about the scheme having poor and illiterate persons, accordingly the prayer for bail of the petitioners are allowed. Let the petitioners above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Bettiah, West Champaran in connection with Gaunaha PS Case No. 64 of 2013.
