The petitioner apprehends his arrest in a case registered for the offence under Sections 406/420/120B/379/34 of the Indian Penal Code.

As per the prosecution case, this petitioner had taken documents i.e. Aadhar Card, PAN Card, photocopy of bank passbook etc. in the name of getting loan and fraudulently, withdrew huge amount from the accounts of informant. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case only on suspicion. F.I.R. has been lodged after a delay of about eight months, without there being any plausible explanation of delay. Petitioner has got clean antecedent.

No.10630 of 2022(2) dt.08-08-2022 2/2 However, learned A.P.P. for the State opposed the bail petition and submitted that petitioner is named in the F.I.R. and there is specific and direct allegation that he illegally withdrawn Rs. 2,50,000/- from the accounts of informant in the name of providing loan.

Considering the aforesaid facts and circumstances, I am not inclined to extend the privilege of anticipatory bail to the petitioner and same is, accordingly, rejected. (Prabhat Kumar Singh, J) anay/- U T
