The petitioner seeks bail in a case instituted for the offence under Sections 302, 120(B)/34 of Indian Penal Code. It is alleged that there is no allegation of overt act against this petitioner. It is mentioned in the written report that petitioner was in custody from the date of occurrence. From the written report, it appears that co-accused Prem Kumar Singh and Sunil Kumar Singh @ Bablu Singh caught hold the son of the informant and Satyam Kumar fired from pistol which hit the son of the informant causing him seriously injured. Petitioner is said to be in custody since 28.11.2016.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.3079 of 2017 (2) dt.06-02-2017 2/2 the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai, in connection with Bhagwanpur P.S.
