This writ petition has been filed for issuance of a writ, order or direction directing to the respondent authorities, particularly Respondent No. 5, the S.H.O, Sonepur (Saran) to release the Goods Carriage Vehicle bearing registration no. BR30G7168, Chassis No.MB1G3HYC3FPYN4847, Engine No. FYPZ120046, covered with Goods Carriage in favour of the petitioner, which has been seized in connection with Sonepur P.S. Case No. 853/2024 dated 16.10.2024 for the offence under section 223, 303(2), 317(2), 3(5) of Bharatiya Nyaya Sanhita

Patna High Court CR. WJC No.295 of 2025(2) dt.28-07-2025 2/2 (B.N.S.), 2023 and the same has been kept in the premises of Sonepur P.S, District- Saran.

3. The petitioner has not moved before the Court below for release of the vehicle in question.

4. In these circumstances, this application is dismissed with liberty to the petitioner to file an appropriate application before the concerned Court below for release of the vehicle in question and if such an application is filed in the Court below then the same shall be considered and disposed of within one month of its filing in accordance with law.
