JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-02-2017 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner is accused in connection with Sitamarhi (Sadar) P.S. Case No. 479 of 2016, registered under Sections 363, 366A and 120(B) of the Indian Penal Code.

The accusation is of kidnapping of daughter of informant, aged about 16 to 17 years, by this petitioner with the help of Swati Kumari and Khusboo Kumari.

Learned counsel for the petitioner submits that the statement of victim, daughter of informant, was recorded, under Section 164 Cr.P.C., in which, she stated about moving from her house with the petitioner according to her sweet will and perform the marriage with this petitioner. At that time, her age was assessed 19

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi (Sadar) P.S.
