The petitioner seeks pre-arrest bail in connection with Dinara P.S. Case No. 317 of 2015 registered under Section 409 of the Indian Penal Code.

It is contended that there is no truth behind the allegation that the petitioner did not handover the register of Kabir Antyosti Yojna to his successor. It is further submitted that the petitioner had handed over the entire records to his successor, but after lapse of several months a frivolous issue has been raised with a view to implicate him in the present case. Be that as it may, regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Bikramganj, Rohtas in connection with Dinara P.S. Case No. 317 of 2015 subject to the conditions as laid down under Section 438(2) Cr. P.C.
