Verma, learned Senior Counsel duly assisted by Mr. Anand Kumar for Bihar State Road Transport Corporation, Mr. Anil Kumar Singh, learned G.P.26 and Mr. Prashant Sinha, learned counsel for respondent no.6.
In view of the counter affidavit filed by the Bihar State Road Transport Corporation and the Employees Provident Fund Officer as well as the judgment rendered by this Court in
Patna High Court CWJC No.4722 of 2019(6) dt.25-08-2020 2/3 CWJC No.1803 of 1992, the petitioner confined his prayer only with regard to refund of family pension contribution till the year 1988.
Mr. P.K. Verma, learned Senior Counsel appearing on behalf of the Bihar State Road Transport Corporation and Mr. Prashant Singh, learned counsel for the Employees Provident Fund submit that if the petitioner submits duly filled up Form 10-C before his employer, the employer shall attest the form and send it to E.P.F. for payment of the deposited amount made by the petitioner till 1988.
On such Mr. Amresh Kumar Sinha, learned counsel for the petitioner submits that he shall submit duly filled up Form 10-C before the competent authority of Bihar State Road Transport Corporation within four weeks from the date of receipt of this order.
Taking into consideration the facts aforesaid and the fact that since other retiral dues of the petitioner have already been paid, I dispose of the writ petition with a direction that if the petitioner submits duly filled up Form 10-C before the competent authority of Bihar State Road Transport Corporation within four weeks from the date of receipt of this order, the competent authority of Bihar State Road Transport Corporation
Patna High Court CWJC No.4722 of 2019(6) dt.25-08-2020 3/3 shall duly attest the same within six weeks thereafter and send the form to the E.P.F.O, respondent no.6, who shall make payment within four weeks thereafter.
With the aforesaid direction, the writ petition stands disposed of.
