JUSTICE BIRENDRA KUMAR ORAL ORDER 25-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 147, 148, 149, 323, 324, 307 and 341 of the Indian Penal Code.

On the way, for trivial dispute arising out of dashing of the motorcycle of the petitioner with that of informant, an occurrence of free fighting took place wherein the petitioner and co-accused Anu Kumar are alleged to have given dagger blow to Pramod Kumar causing injury at the neck and abdomen. The doctor has found incised wound at the left middle of chest below the nipple and an incised wound over left arm. Submission of the petitioner is that the petitioner is

Patna High Court Cr.Misc. No.3655 of 2017 (5) dt.25-04-2017 in custody since 19.11.2016. The occurrence allegedly took place when the petitioner was in inebriated condition and the injured has admitted that the petitioner also sustained injury at the hands of injured during free fighting between the parties. Learned counsel for the informant opposed the prayer for bail.

Considering the entire facts and circumstances specially the period already undergone, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Chapra, DistrictSaran/Successor Court, in connection with Dariyapur P.S. Case No.294 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
