2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 302, 201/34 of the Indian Penal Code.

3. As per the prosecution case, six years old informant's son had gone to watch Tilak Ceremony at the house of co-villager, and when he did not return, informant started searching him. In the meantime, he heard some sound near the bamboo grove and when he reached near the same, he saw the petitioner and other accused persons fleeing from the spot. However, villagers caught some of them and dead body of informant's son was recovered from the said bamboo grove.

4. Learned counsel appearing for the petitioner submits that on perusal of the FIR, it appears that petitioner was seen running away from the spot and on suspicion he has been

Patna High Court CR. MISC. No.21645 of 2025(5) dt.29-08-2025 2/2 implicated in this case. No overt act has been alleged against the petitioner. Petitioner claims clean antecedent. Charge sheet has already been filed. Petitioner is in custody since 23.1.2025.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Arwal in Kurtha Police Station Case No. 120 of 2024.
