JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-09-2022 Though the present writ petition has been filed for quashing the notice dated 04.04.2019, issued by the Rehabilitation Officer, Koshi Project, Supaul i.e. the respondent no. 4, however, it is the contention of the petitioners that the petitioners have already replied to the same vide reply dated 13.09.2019, which is annexed as Annexure-5 to the present writ

Patna High Court CWJC No.6432 of 2021(2) dt.14-09-2022 2/2 petition, hence the respondent no. 4 be directed to consider the same and pass appropriate orders, in accordance with law as also taking into account the notification issued by the Water Resources Department, Government of Bihar, Patna dated 08.09.2016, which shall be produced by the petitioners before the respondent no. 4.

Having regard to the facts and circumstances of the case, the present writ petition stands disposed off with a direction to the respondent no. 4 to consider the reply of the petitioners, filed in pursuance to the notice dated 04.04.2019 and thereafter, pass the final order, in accordance with law, if not already passed and till passing of the said final order by the respondent no. 4, it is directed that status quo existing as on today, shall be maintained.
